Hey Guys,

I have an active fugitive out of Bergen County NJ and I know his whereabouts...which is Orlando FL. Not a huge bond, a 10K, but we just had to pay it last week and i found out yesterday where he is. Now I want to get him and file for remission.

I keep getting conflicting reports from different people and I cannot figure out the truth. I called bondsman in FL, my insurance company, a couple hunters, police and i get different reasons.

Some people tell me I cannot pick him up because I am not licensed in FL, but when I look in the Florida law part, all it says is that you cannot bounty hunt but if you are a licensed bail bond agent from the state where the bond was written, then it is legal. One cop told he no and the other told me ok. A couple bondsman I called said they don't want to do it - but I am not sure if that is because they are not interested or its not legal. I have no problem with going down to FL - but I want to check my facts before i go.

Can anyone shed some light on this for me? I tried searching the site but I cannot find any similar posts. Any help is appreciated.

Are you . . .a Licensed BBA in the State of issue? If so . .. the answer to your question is YES

Yes, I am a licensed bail bondsman in the State of NJ (I am the MGA) - where the warrant was issued and bond was written and I personally wrote the bond.

My main question is do I have to personally go and do it myself or can someone in FL help me do it?

you can use a florida licensed bondsman,LE and you may go yourself. IF you need some help i can hook you up in Florida just about anywhere

Bounty Hunter Provisions. Florida does not allow bounty hunters.

Apprehension of bail fugitives is only allowed as set forth in FS 648.30(2)&(3):

(2) No person shall represent himself or herself to be a bail enforcement agent, bounty hunter, or other similar title in [Florida].

(3) No person, other than a certified law enforcement officer, shall be authorized to apprehend, detain, or arrest a principal on a bond, wherever issued, unless that person is qualified, licensed, and appointed as provided in this chapter or licensed as a bail bond agent by the state where the bond was written.

Violation of this is a 3rd class felony. [FS 648.30(4)].

Been there a number of times, had no problems and LE worked with me... I will confess that in my very early years I actually sent two "licensed BEA" guys out of Virginia to FL who apprehended and returned to me my defendant... after I exonerated the case I found out to my horror that myself, the two fellows that went in to Florida to do the apprehension, could have been charged, jailed, fined and my license revoked... ignorance is not a defense... but you have good info from Dave on the procedures... just be totally aware.. correct me on this Dave but can't a Florida licensed PI do this also, with proper paperwork???

A PI has no arrest power in Florida unless a special commission is given

LOL David I was just going to say that.

roblapnj. . . . Road trips are always nice. Just make sure and check in with the Locals. The company that I write for has had to get a couple of wayward souls out of Florida . . . . you will find that they don't want another States' refuse any more than another State wants theirs :-)

Ok, I wasn't sure on this, I know recently, I was in Tampa area on a case and I recall talking to a PI... unmentioned... and he said something to the effect that a special paper could be issued... but I did not go there... I was only seeking info at the time and it was my sons' case so I really was not going to pick up the defendant, just gather some info... yep, that's why I ask the questions... thanks.

Thanks for all the input guys. After reading your posts and talking on the phone, it seems that I can do it as long as I have my paperwork in order and don't act like a cowboy (not my style anyway).

It seems that FL Statute 648.30 is enough.

Maybe I should roll into Orlando with 10 guys, three new Chevy Suburbans, some paintball guns and a camera crew :)
