I think that perhaps there should be a "private section" and that whenever a topic of that nature comes up the moderators could move it there... some things start out as public but then become private.

Some states have laws which compel the prosecutor to seek charges and some even make it a chargeable offense if they do not. Have to search through your statutes to see if colorado has such a charge (they probably do, you just got to find it). Then if they persist and you don't have a problem burning a bridge or two (heck if you can't walk on it anyway, why not burn it down? LOL), then file the charge with the the State Attorney's office or Attorney General, whichever you got.

Don, I'll check into that. I don't have a problem pushing the issue if it will help us in the long run. Maybe if a few arrests were made people would start getting the message that we are serious.

Here is one of the methods that may work, and before I get hammered for copywright infringement, It is listed in one of Bob Burton's bounty hunting books:

Put some money in a western union account under his name, then call the gf's and say that you are trying to reach Mr. so and so regarding his unclaimed money...tell them he needs to pick it up at store so and so by 9am or whatever...or the money will be returned to the sender as unclaimed.

When they call Western union to verify if money is really there it will be...however, the reps cannot say how much is there...so you can put as little as $5.00 in it...

2nd trick: If you have any friends who are car dealers..see if you can get a loaner, and send a certified registered letter in a dummy envelope annoucning he is a grand prize winner of a car....instead of using publisher's clearing house....which you can't do legally..you could label the outside of the same kind of brown envelope as "publisher's weekly sweepstakes"..make it resemble PCH as much as possible....when he calls to claim his prize...tell him you will come pick him up in his new car (used actually or demo or loaner) and when you show up with other BEA's dressed as cameramen, balloon girls, a big cardboard check, etc etc..then you grab him.

Remember all BEA work is strategy...a chess game... if you study chess with multiple players..then you become a better BEA.

Additional leverage:

I just realized, after re-reading your posts, that these 2 young girls are on welfare ?..if that is correct, you can threaten to have that cut off. In most states, with all of the issues surrounding "the no more free lunches" programs they actually have conditions surrounding state and federal welfare programs...obviously some of which are 1)no criminal activity
2) No associations with known felons or criminals.

I bet you if you did your research and really dug into it you would find some disqualifying factors regarding welfare or unemployment payments.

Now, you are hitting the co-signer's where it hurts them the most..in thier pockets..just don't tell them about it..print it out with the actual state laws or statutes and show it to them in writing....If you can't find a state one you probably can find a federal one.

Then see how fast they give your skip up.

One other idea....bring a child services agent with you...threaten to remove the child if she doesn't give the fugitive up.

Also, If the fugitive is the biological father of these kids, and he is not paying child support, then you can get warrants from the da's office on criminal non-child support...that's a whole different leo ballgame.

There is a 1995 ? or 1993 Federal child support Act which most attorney's don't even know about..Basically the gist is this: if you are court ordered to pay child support in one state, and you job hop, get paid in cash, etc..move from one state to another to avoid wage garnishment, and you become a min of $5,000.00 in arrears, then you can have a FEDERAL warrant issued for your arrest by your local Federal Judge who will then turn the case over to the U.S. Marshall's office for apprehension.

I have used this tactic in one DV case here and won my case for the client.

I think this is great, I can't wait to try it.

I'm also going to start looking into the welfare laws as well.
