One of my buddies who is a sub agent like me for my boss. Went to NC to pick up a fugitive. Called law enforcement because the female defendant threatened to shoot the BEA. Law enforcement showed up and said they couldn't assist. The BEA said he didn't need for them to arrest just to sit and make sure the situation doesn't escalate. The BEA said he was going to make force entry and the LEO said no i will take you to jail if you make forced entry. Then the BEA said I don't care the Defendant is my property and im going to make forced entry because I have the authority to do so! The officer said no you don't thats only in south Carolina that u can make forced entry. But we do have the authority by the SUPREME COURT to make forced entry if nesscarry no matter what state as long as you have a certified copy of the bond. Its not a state thing only in certain states can we not goto to make arrests period. If that is a fact than the D**N Law is to help the criminals and not to help the BEA or maybe that was just an @$$ hole LEO. If anyone has any different Info i couldn't find anywhere in the state law of NC that said different. Please help thanks!

If memory serves me only a NC licensed FRA or bondsman may rearrest in that state. You can shoot an email to Mr. Max Astor who is a member here. But i believe you guys were in the wrong and if what was said was said that is the most unprofessional way to handle this situation. Of coarse this is only an opinion of an old man.

I would like ALL true Professionals to REALLY READ this posting from Aardvark. I will post later WHY each state is enacting laws concerning OUR Profession. This guy is a PRIME reason WHY!

I knew my answer was right on NC laws but wanted Max to confirm it as he is from there so there would not be any questions. I was holding my breath as to not blast them for posting something like this :evil: .

Yup, Must comply with each states laws, No matter if you got warrant or not....Not to educated.

I don't know about NC but in CA you can only force your way in if the skip actually OWNS the house. Even then you may find yourself being arrested and paying a LOT of money to an attorney to prove you are right....and don't count on Taylor v. Tainter or ANY other federal law as a defense. We have always found it is much easier to apprehend in a more public place (work place, outside a restaurant, etc.)

Indiana Code 10-3-14 Bail Agents and Bounty Hunters cannot forcibly enter the home of a Third party. So its the same here in Indiana
