Here in California that detention is know as False Imprisonment.

Also in California, only specific officials with Peace Officer Status can "serve" warrants. Its in our penal code. If you say you are serving an arrest warrant for a bail skip and the wrong police agency find out about it, you can be charged with impersonation.

You can say that you are there to arrest the bail skip and that there is a warrant for their arrest but, you better make clear that you are not there serving an arrest warrant.

If you do so, the average person may think your are acting as law enforcement and CA LEOs are starting to crack down on agents.

I am very disappointed in you. Nice way to turn an attempted positive post back into a negative post. I don't know what facts I need to check again. You are a small town bondsman from rural NC that is not experienced in big city bail. To put it another way; my son ran the bases at Tiger stadium last summer but that didn't make him a professional baseball player. I will take your word on your stats for our company but remind you that those arrest (at least in majority) were made in rural NC over a multiple year period. I get it that you don't link me but don't rob people from the opportunity to learn. You do not know ANYTHING about me, you have NEVER met me, and only spoke with me once by phone...I think you might be a rather poor judgment of me. As to Googling our company; I googled both You Walk Bail Bond Agency and You Walk Bail Bond Agency Reviews and it took 4 pages to find my first negative review and I believe that came from an ex-employee who has connections to YOU.

I don't care what you stay about me and I don't think about you. Your opinion is immaterial and from a much lower pay-grade than I would care. If someone raise Michigan or Ohio bail, my name is in the mix...and yes its good things. Insurance companies want me to represent them and they have a much broader opinion set. However, when you attack my employees, especially with no knowledge of them or their efforts, I will defend them aggressively. They do not deserve your venom. They have NO connection to any prior alleged incident, so, once again, a pattern would not be drawn. You made 64 arrests for us in a multi year period with no incident and they made over 100 since this alleged incident (3 months) with no incident. So, I think they do deserve the benefit of the doubt, especially from our industry. You may say they are "innocent until proven guilty" but your posts really imply guilt by association with our company, which is what you would owe them an apology for. Although our company has an extremely small set of alleged incidents. Since you do not represent the media, I would not discuss how we handle the media unless someone asks.

My long post had nothing to do with you and was meant to hopefully garner a discussion on what can be done to protect a young recovery/bail agent from a similar situation. I know you don't like me but I am fairly successful and have a long career, so maybe someone can learn something from my company's experiences and that would be a good thing. Don't let your negative attitude prevent someone from learning something.

maybe you can educate me on yourselves and your companies a little. I am aware of your name Tony but I don't know much beyond that and i'm sorry Mike but I have not heard of you before.

Maybe you can help me understand what you mean by "this would be false imprisonment" in California. What would be false imprisonment? Yes, if you take the allegations on their face there were a ton of violations but I think that everyone here can agree that you should never do that. In no criminal incident are the allegations spot on. Both of you comment as those the allegations are fact but even the charges show that there is question as to fact because we also have "False Imprisonment" here in in Michigan, as do most states, and we can all agree that if the facts bore that out then they would have been charged as such. Last I checked, an approved search of a residence does not meet the requirements to obtain a conviction for "False Imprisonment."

I think that your comments do not help to enlighten or teach anyone. You guys want to all treat my guys as guilty because of a News story but that isn't just or fair. No one has asked any relevant questions beyond, did they have a picture of the defendant. I am, and always have been, happy to discuss anything about my company in an attempt to help others learn. But this forum doesn't sound like people trying to learn or educate, it sounds like me defending my guys against a group of people that want to tear others down before they know anything beyond a news story and a poorly constructed legal complaint...which I doubt any of you read. I have seen this from several posts on this website, not just posts about me or my company. I know that Tony and Bill are active on this site so you should be aware of the tone you set.

I hope that those that run this forum can turn this thing positive because the industry needs it. This is just an example of our industry attacking each other. You would never see this out of pretrial services. You have the right to say and do anything you want but this forum does more harm than good. We are along way from Arizona 1997. I introduced a law here in Michigan that would have heavily regulated recovery work but it was defeated because the Insurance Companies didn't want to support it. We are losing ground in this industry because instead of learning and teaching, people want to attack and tear down.

I don't know why you would think my "tone" in the comment I posted needs to be "careful."

I was only pointing out the fact that in California, and you should know this as you used to have offices here, that only certain law enforcement officials can serve "warrants."

If an agent goes out and tells an individual that they are "serving a warrant" that could in most people minds and definitely in LE eyes that you are implying your are LE.

Now if a court judge issues a bench warrant and tells you to go pick up that bail skip, you may be acting within then law.

But as you know also, then you would be a "state actor" and potentially create liability for the state.

Bottom line is, when picking up a bail skip, we are not serving warrants. Simply because there is a bench warrant issued doesn't mean that the agent is acting on it.

Bail agents are enforcing a civil contract, that's all.

So in one of your responses you stated that your agents served over 500 warrants. Maybe you can say that and Michigan LE don't care. Things are getting hot here in CA and LEOs are being "educated" to the dos and don'ts by agents.

Well hell guess Im just a small town boy too not really educated in "Big City" bail. My company I was on retainer with is only one of the biggest in Ca with a standing caseload of 50-70 cases a month. Worked in those small rural towns near Tony like Oakland ect...
