Out of state recovery

I have a skip that is in oklahoma, from my understanding an out of state hunter can go into oklahoma and pick someone up accompanied by the local LEA or a oklahoma bail bondsman. I know that you have to have a liscense to hunt there. I just want to know if the above exception is true.

Also, from what I gather, there have been some relatively recent changes in Oklahoma's legislation regarding recovery agent licensing requirements. I don't know if these legislative changes have affected professionals from other states (a "demanding" state) pursuing bail bond fugitive's within the state of Oklahoma. You should probably research Senate Bills 1013 and 1872 (S.B.1013 & S.B.1872).

There is a lot of info in the articles you suggested, but nothing pertaining to out of state hunters. I have contacted some bail bondsman in the state and have been told different things. Thank you for your advice. I believe I will call the local LEA.

I've re-arrested a couple folks in Oklahoma and can tell you this from my research and experience in that state.

If you're going there as a bounty hunter you might want to reconsider.

If you wrote the bond, or are appointed by the insurance company that wrote the bond, you should be alright.

All out of state recovery agents must call the local sheriff's office prior to an arrest. They won't help you but they'll stand by in case you screw up. That's been my experience.

On second thought, it's been over a year since I've recovered anybody there, so calling local law enforcement before going is a good idea.

I need some advice on making an out of state recovery,that requires a license to hunt. If the defendant is not in NCIC, will the local authorities make the arrest for me based on the warrant I have from the bondsman

I doubt that a law enforcement agency would arrest anybody who has fled to their state ("asylum state") from another state ("demanding state") without first being able to verify an extraditable warrant that has been entered into the National Crime Information Center (N.C.I.C.) warrant system. If a warrant has not been entered into the N.C.I.C. as being extraditable from the asylum state, then a law enforcement agency in the asylum state would have no reason to arrest the accused; arresting the accused in this type of situation would basically be a waste of law enforcement resources.

Here are some extremely important questions for you:
How much time remains in the forfeiture period?
Is the underlying offense a misdemeanor or a felony?
Which state is the asylum state?
Which state is the demanding state?

I would suggest that you approach the authorities in the demanding state and pursue having the warrant entered into the N.C.I.C. as being extraditable from the asylum state.

If you can do so, you might also consider pursuing a U.F.A.P. (Unlawful Flight to Avoid Prosecution) warrant. Approach the Prosecuting Attorney in the demanding state with a written request for a U.F.A.P. warrant. In your initial request you should include that you are willing to pay for all extradition expenses. You will also need to provide proof that the accused has fled the demanding state (Thanks, KARMA & Mdbtyhtr!).

You should also research the provisions of the Uniform Criminal Extradition Act.

As you can see, there are a lot of variables that must be addressed and you should offer more specific information about your situation in order to elicit the appropriate answers. Good luck and happy hunting!
