To any bondsman in Horry County, South Carolina

I have a fugitive that was arrested on a serious Domestic Violence charge in Horry County, South Carolina. He has been a fugitive from my area in Trumbull County for more than 5 months. He is a flight risk and WILL RUN! His bond is currently $7500 and is incarcerated in the Horry County Jail. You can see his photo and charges at the county's website www.horrycounty.org click on the link on the left side of the screen that says booking and type his last name into the field. Hopefully I will be able to get a hold on him so he can be transported to my county in order to recoup our bond forfeiture here.

Cant you file a Motion in Horry County, South Carolina, to get Off The Bond due to your defendant being Incarcerated at another Correctional Facility ? ? Just wondering... unless your state doesnt accept motions like this...?

I just had a similar situation where we had a Female out on a Palm Beach County Florida Bail Bond for $7500 and she was currently arrested & in Jail in a New Jersey Correctional Facility and we were able to motion off the bond..

I know every State and Situation is different .. I am only asking since your Court where your bond is may not allow you to file this motion to get off your current bond...?

In NC, you can almost always get off the bond if the defendant is incarcerated in another state on the day he/ she fails to appear.

If the defendant is arrested and incarcerated in another state after the date he fails to appear, as ordered by the courts....Good Luck.

I know we're talking abot different states but thought I'd mention that for NC Bondsman

Jeff, after re-reading your post I realize I might have miunderstood.
I have a client that has a skip that is incarcerated in Greenville,SC.

My client's attorney is trying to do exactly what you are suggesting.

To my knowledge this has never worked in NC but I'll keep everyone posted as events warrant.

You need to get a letter from the jail in SC that confirms your defendant is locked up there. then give that to your bondsman so that they can petition to get off the bond.
