*****UPDATE***** i finally got a hold of my ex and spoke to him about everything!... he wanted to know where i got all my info?... lol ... didnt say a thing about all your help , but he says that he is burnt out on running , and wanted me to find out the best way to turn himself in!.. he said he does not want to sit in a mexican jail!... he asked if its possible to turn himself into a bail enforcement agent from the bond company that has his bond , and cross back in his custody?... is that possible?... geeze im so relieved , i just pray that he does what he says he will do!... i believe he will cause i know he doesnt want our kids on the streets or in fib=nacial disaray!... he said he was just scared to go back for the length of time they want to give him!... i appreciate all you have all contributed to my situation , i know this is a professional site , but its nice to know that normal prople can come on here for advice and support!... thank you very much to all of you who have helped!... sena

The best thing for your ex husband to do now is contact the Bail Bondsman and arrange his surrender with them after he crosses back over into the United States...
Good Luck in your situation .. I hope he does the right thing.. sounds like he might be coming to realize that he has to step up and man up for his mistakes.

I have stayed out of this and would think that your best option would be to meet your husband at the border yourself and drive him to the jail and surrender him personally, getting a body receipt from the jail. This will keep the bondsman from charging you for fees for expenses he did not incur. If a Bounty Hunter gets involved, you will be paying for it. This option will only work if you feel that he will voluntarily go with you. If not, then get in touch with the bondsman and have him meet you when you meet your husband. I know you love him, but love doesn't put a roof over your head. The bondsman can set it up to look like they were following you, without your knowledge, happens all of the time.

Agreed, he should cross back and can surrender in El Paso. However, if the state decides to extradite him back to CO, they may charge the bondsman their costs. And he or she will then charge you for that.
It could be a thousand bucks or more.
If he is serious and honest about not wanting to take food out of the kids mouth, he should find his way all the way back to your local county jail on his own or with your help.

hi guys... its me again sena! ... quick question to the experts! can a enforcement agent escort my ex from the mexico side through u.s. customs so customs does not arrest him and then have to go to the local jail , and then do the whole extradition thing back to colorado? ... he wants to meet the agent and go willingly across and of course be in the custody of the agent on on his way back to colorado as quickly as possible? ... i know im asking silly questions but i just want to make sure i get all the info i can get to pass on to him as to make him comfortable about all this!... any and all advice would once again be greatly appreciated!... thank you!

No, the agent would be arrested for kidnapping in Mexico, as would your husband for being a fugitive. The agent, were he to meet your husband at the border crossing, would be required to magistrate your husband in TX, and then proceed with formal extradition to Colorado. Why would your husband not come back and get on a bus and enjoy his freedom until he self surrenders, it would save you both money.

well , he has a warrant for his arrest and he told me that when he goes through customs going back they will arrest him , and also he has no passport!... he was hoping that he could just cross back with the agent , and the agent can say that im taking custody of him rather than being arrested by customs!... cant the agent just be with him , not having him in cuffs and such? ... it would only be kiddnapping if the agent arrested him , i guess he figures if the agent is with him he can avoid being arrested by customs!!!... UGH!!!

The main question i have is, is he a US citizen or not, because if he is not then there is not really an easy way for him to walk back into the country, you would have to get Mexico to extradite him back to the US, and if CO is anything like MD they wont, i have dealt with this before on a skip that left the country with duel citizenship and then dropped her US citizenship, So to bring her back would have been kidnapping.
