CA Bill to Ban Open Unloaded Carry

A new law to ban unloaded open carry in California is a sure bet to pass. This is in response to recent open carry parties held through out CA in an attempt to open up the CCW laws to do away with the "may issue for good cause" clause in our CCW law and make CA a "share issue" state.

Well, it seemed to have backfired.

SEC. 8. Section 12037 is added to the Penal Code , to read:
12037. (a) A person is guilty of openly carrying an unloaded handgun when that person carries an exposed and unloaded handgun outside a vehicle on his or her person while in any public place or on any public street in an incorporated city or in any public place or on any public street in a prohibited area of an unincorporated territory.
(b) A violation of this section is punishable by imprisonment in a county jail not to exceed six months, by a fine not to exceed one thousand dollars ($1,000), or by both that fine and imprisonment, provided, however, that a violation of this section is punishable by imprisonment in a county jail not to exceed one year, by a fine not to exceed one thousand dollars ($1,000), or both that imprisonment and fine, if any of the following circumstances is pled and proved to the trier of fact:
(1) The firearm is stolen and the person knew or had reasonable cause to believe that it was stolen.
(2) The person is an active participant in a criminal street gang, as defined in subdivision (a) of Section 186.22, under the Street Terrorism Enforcement and Prevention Act (Chapter 11 (commencing with Section 186.20) of Title 7 of Part 1).
(3) The person is not in lawful possession of the firearm.
(4) The person has been convicted of a crime against a person or property, or of a narcotics or dangerous drug violation.
(5) Both the handgun and the unexpended ammunition capable of being discharged from that firearm are either in the immediate possession of the person or readily accessible to that person, and the person is not listed with the Department of Justice pursuant to Section 11106 as the registered owner of that handgun.

There is not enough money in the world to get me to live in the land of Fruits and Nuts. I have family and friends there that live in Northern CA, and claim its great. But the laws are the same and dominated by southern CA. Much the same as the way IL is dominated by Chicago. Which btw, thats another state I wouldnt live in.

If I ever leave MO, I will probably end up in one of the other few free states left, like AZ, MT, WY or AK.

Actually,

The most stupid, insane liberal laws are made in San Francisco or Berkeley and permeate the rest of the state.

Also, we have the 9th district court of appeals in S.F. which comes out with the most over trurned federal cases in the country.

So, northern CA is the epicenter of the fruits and nuts!
