Wow,
I sincerely hope that the facts come out in his favor, time will tell.

Balderas said this afternoon that Flaming and his company did not have the correct licenses to come into Texas in an attempt to apprehend Graves.

"They didn’t have any right to come here," he said.

See this is what happens when people think they know the laws or don't check to see what the laws of other states before they enter them.

It seems to me that this guy or his company already had a bad rap before this even happen. I just can't beleive his other guy that was with him wasn't charge with anything.

Texas laws are very specific in that only a licensed PI can make an apprehension there on Texas bonds, but the law does not specify if the same is required from a person coming in from another state for a bond in the other state. The law is ambiguous enough that until a court ruling is made, nothng prevents somebody from another state from making an apprehension there as long as they follow the state laws regarding attire and entering residences.

That being said, this case may cause such a ruling, but depending on the circumstances, I see it as more of an illegal "show of force" case than that the person was acting illegal in his job. If the defendant was shot because he was fleeing, then it was murder. If he was shot because he was shooting at the bondsman then it was self-defense, and that should be a viable defense.

Anybody else feel swelling around their eyes? We just got another black eye. All from some cowboy, if you read the comments below the second article, who has no business doing this line of work.

If these type clowns arent weeded out, and fast, from our industry, we will have no industry in a short period of time. It seems we are hit on two fronts. More of the clowns showing up, since the Dog became famous. And, the media seems to have a woodie for anything related to our business, on the bad side anyway.

Whether it was self defense or not, he had no business being there. Period. Should have found some other way to handle the case. Hang him.

If we dont police ourselves, and take a stand against the bad apples in the business, we will all be out. Sorry for being so blunt about it, but I have no patience for them.
