Ok,

I just emailed "the dog" and got a reply regarding licensing. Below is the email I sent and the reply.

I have fowarded it to the Indiana Licensing Board as evidence that they were informed should they still attempt to act as an investigator or recovery agent in Indiana without proper licensing.

You will see from the rather short and to the point reply their intention is to proceed without licensing.

Private Detective License.

The completed application should include the following:

______CRIMINAL HISTORIES (city, county and state)

______CERTIFICATION OF EXPERIENCE FORM

______AUTHORITY TO RELEASE INFORMATION FORM

______CERTIFICATION OF OUT OF STATE LICENSE (if applicable)

______PROOF OF SURETY BOND OR LIABILITY INSURANCE

______CURRENT PROOF OF INCORPORATION (if applicable)

APPLICATIONS MUST BE COMPLETED ONE WEEK PRIOR TO THE BOARD MEETING FOR CONSIDERATION BY THE BOARD

Pursuant to Qualifications for License, IC 25-30-1-8 (b), if the applicant is a corporation or a partnership, one (1) officer in the case of the corporation, or one (1) partner in the case of a partnership, must meet the personal qualifications as set out in subsection (a), unless otherwise provided.

OUT-OF-STATE APPLICANTS ONLY

All non-resident applicants must comply with the above instructions in addition to the following:

Must obtain an Indiana state review challenge (criminal history).

Submit a letter of certification of licensure and a copy of valid private detective license from each state of licensure for each applicant (if applicable).

Must have an Indiana Resident Licensee with a valid Indiana private detective agency license. A letter from the Indiana licensee stating that he/she has agreed to be your Indiana licensee along with the name of the agency, license number and address will satisfy this requirement. Please refer to IC 25-30-1-14 for the duties of an Indiana Resident Licensee.

IC 25-30-1-2
Definitions
Sec. 2. As used in this chapter:
(1) "Person" means an individual, a firm, a company, an association, an organization, a partnership, or a corporation.
(2) "Licensee" means a person licensed under this chapter.
(3) "Private detective" means a person who conducts a private detective business with or without the assistance of an employee.
(4) "Private detective business" means the business of:
(A) making, for hire or reward, investigation or investigations for the purpose of obtaining information with reference to:
(i) a crime against the state or wrongs done or threatened;
(ii) the habits, conduct, movements, whereabouts, association, transactions, reputation, or character of a person;
(iii) credibility of witnesses or other persons;
(iv) the location or recovery of lost or stolen property;
(v) the causes, origin, or responsibility for fires or accidents or injuries to real or personal property; or
(vi) the truth or falsity of a statement or representation;
(B) securing, for hire or reward, evidence to be used for

authorized investigation committees or boards of award or arbitration or in the trial of civil or criminal cases; or
(C) furnishing, for hire or reward, a guard or guards or other persons to protect persons or property or to prevent the misappropriation or concealment of goods, wares and merchandise, money, bonds, stocks, choses in action, notes, or other valuable documents or papers.
(5) "Industrial plant" means a factory, business, or concern that is engaged primarily in the manufacture or assembly of goods or the processing of raw materials, or both.
(6) "Board" refers to the private detectives licensing board established under section 5.1 of this chapter.
(7) "Licensing agency" refers to the Indiana professional licensing agency established under IC 25-1-6.
(8) "Resident" means a person who has established an actual domicile in Indiana.

Necessity of license
Sec. 3. It shall be unlawful for a person, partnership, or corporation to engage in the business of private detective, or to solicit or advertise for business as a private detective, or represent or hold the person, partnership, or corporation out to be a private detective unless the person, partnership, or corporation is licensed under this chapter and complies with this chapter and rules adopted under this chapter.

She is on an emailing Spree. She also emailed an internet friend of mine and basically threatened her. I hate to say this person's name because she is a fan of the show, but not of Beth Smith

Well, I'm not going to argue with her. I just forwarded that email to the Licensing Board as evidence of their notification should they enter Indiana and attempt to perform duties that are directly covered under the licensing requirements.

They can call themselves "man hunters" all they want. They will still have to pay the fine and add another offense to their resume's... who knows maybe they will even be arrested. That would be funny.

As far as I'm concerend, if we all had to go through the rigamorole to get a license then they should too.

Don I hope he goes to indiana and gets popped for unlicensed pi work--he is acting as a pi if he investigates, does any servailence , questions anybody, accesses any records, and or follows any body-he also leaves himself poen for a stalking charge if he servails people

He does have the right of citizens arrest is he sees the bad guy-- du-du and crew are really affecting legitimate beas and pis with his bluster and bravado. his foolish attitude in bea work gives the wrong impression to millions of people in tv land and will one day wind up seriously hurting either his team or some other 3 day wonder who thought he can be dog--there is some rumor that hawaiian pd has a task force trying to take down du-du

Yes, it would be good if he got caught.

Beth apparently didn't read all the way down on the "Definitions" section of the Indiana Code that I so graciously supplied.

If he does come to town and starts asking questions, this email (already forwarded to the IN PI Board) and their reply should be able to serve as evidence of their intent to violate current Indiana Code.

I just hope the board will want to pursue charges if and when that happens.

Maybe the whole celebrity thing carries more weight in the spirit of the law area when it comes to discretion...

Recall that Mr. Chapman worked the Luster case in California without meeting standard certifications, and I guess some filming was done here again recently with no ostensible regard for California law.

A convicted felon cannot lawfully possess body armor in California without first getting permission from a police chief or sheriff, and a convicted felon is prohibited from doing BEA work in California as well.

Private citizen arrest is fairly standard here, but, like Don & Hadley stated, only a licensed PI can do the type of work suggested on this topic in this state.

It will be interesting to see if Mr. Chapman decides to work the case and whether or not the authorities will intervene before, during or after the fact.

The charge of doing PI work without a license is in effect of a slap on the wrist and a fine. Indiana law on this is pretty lite. The other charges that could be filed aganist him would and will carry a stiffer penalty should they be charged. A good lawyer could tie a case up for a long time and make the state spend allot of money to charge him that it would be highly possiable for the state to not proceed with any filings against him.

I originally posted Chapman's many court appearances in Colorado courts but I need to check the legality of posting such a record in a forum. If it is legal then I will repost. In the meantime I will send it to interested parties via email only.
