I have been lurking on this board (and several others) for quite a while now. I am fairly new to bail enforcement, having worked part-time in this field for a little over a year.
I was recently certified in the use of O.C. spray and I have a question. If I ever have to use pepper spray in a self defense situation while apprehending a subject, I understand that I will need to either take the subject to the ER or call an ambulance so the subject can be decontaminated before the local jails will accept him or her. My question is: Who is responsible for the medical cost incurred? My instructor had
previously only worked with LEO's and private security companies and did not know the answer.
BTW, I check this forum at least once or twice a day, and feel like many of you are old (and well-respected) friends.

Have a good and safe week. Kevin that is a good question, this is only my opinion and not a lawyers advise. We ,you are held liable for your subject when they are in your care,our company has a use of force sheet that must be filled out if any force is used this includes Physical, Chemical Agent,Impact Weapon,aimed firearm,our company lawyer drew this up it states on the form if chemical agent was used was suspect allowed fresh air and water.

Kevin,
Which discipline of OC did you get certified in? In the method I teach (O.C.A.T.) there is no "decontamination". There is Post Exposure Cleansing. The OC is a food product, not a chemical, therefore no "decon" is necessary.
Fresh air, clean running water, whole milk, baby wipes, baby shampoo can all be used to help clean the skin of any residue. Also, There is no medical treatment necessary unless the subject request it or the effects last longer than 45 minutes.
As long as you keep exposure to a minimum and can wait an hour or so before turning your prisoner over, there SHOULD be no residual effects.
As for that expense, it depends on your contract with the bondsman.

Hey Guys,
In actuality, I'm not really that advanced just yet, but sometimes I have to wonder whether or not age is a factor in some of my declining sports stats in some areas and increases in others.
As always, study the local and state laws where you intend to work with respect to pepper spray.

Your stats are not decling. Its just your math has gotten bad due to all the computer and technology use. We can't do simple math in our heads anymore.
In our local area, the recovery agent or the bail agent would ultimately have to pay for any er or paramedic treatment to anyone they injure. The State does not pick up the tab for private actors!
And why should they?
