My general agent, who is also an attorney, told me that often defendants will choose not to hand over a large amount of money to the courts because then prosecutors may question where the large amount of cash came from. This is particularly the case with those arrested for drug crimes.
By going through a bail bond agency, the source of the payment is not known to the courts or prosecutors. The premium is a small amount to pay not to have questions raised.

Several issues here...

If you pay the full amount to the court, they can seize it as drug proceeds, they are out the money and still in jail.

If you pay the 10% to the court, as many jurisdictions are leaning to, they tell you that the money is refunded upon appearance. They don't tell them the money is not returned unless they are found not guilty, PBJ or stetted and they keep the money.

There has been cases where a bondsman has had collateral seized by the courts as potential drug proceeds. We are required to acknowledge in writing and affidavit any collateral taken on a bond, and that is how they know.

What?????????????? a fish is what you catch early in the day..... a phish (pronounced fffffiissszzzzz) is what you catch after you have had 15 (or more) Bud lights (with lime)... it a lot harder to get it in the boat but you really don't give a sht one way or the other....

I can't believe you went to a Zeppelin concert..... however, I went to one too one time.... not sure when it was however.... I went to a Super Tramp concert and a Grand Funk concert with my son and when it was over..... we had to wait an hour until the "smoke" cleared.... and then I could just barely walk to the car.... damn that smoke smelled sort of sweet and funny................... :shock: :shock:

Hey, LadyS.... I did go to see Kris Kristopherson and Rita Coolidge in Hampton one time..... many years ago...

I still have Zepplin on my Ipod.... (can you believe at 65 I listen to them??)

I always take a bunch of cards with me to any event like this.... stick them in all sorts of places.... bathroom mirrors.... edge of the windows at the hot dog stand.... under the mustard bottles.... in girls pan-- oh, no.... I mean.... under windshield wipers.... you know... all kinds of really high class advertising like that.................. true professionalism.... :shock:

That is great advise... likewise, if I write an out of state defendant I will go for full collateral or an indemnitor that is a blood relative and is local and owns their home or has been on a good job for at least 10 years and fully understands the risks involved. I live close to the state line and also I-85 and I-95... lots of north south stuff moving through all the time... I do write these bonds but you can bet it is written tight and with collateral.... I turn down many and my competition writes a lot of them I turn down... but he is also giving you guys a lot of business looking for the skips.................. I have recommended several of you local BEA's to him.... hope he calls you.

The only conerts I remember are Buddy Rich, Chuck Mangione, Poco, a Pink Floyd pratice session, America and Chicago. Oh and Neil Diamond.

Geez there must have been more. I just don't remember them. Maybe all that blue smoke blanked out my memory.

In a couple of counties near us, if the DA suspects drug money was used to post bail, either cash or surety, the co signers have to prove where it came from before releasing the defendant.

So even going through a bondsman is not always a sure thing.

Tony we think alike, I’m amazed at the risk some are willing to take for that small premium and posting fee. Imagine writing a $25k bond on a foreign national with prior FTA’s and not asking them to surrender their passport. And the indemnitor (Mom) was also a foreign national.

Also agree good info here, always like to hear the Bonding Agents perspective.

Just to add more to this...

Real Estate is almost worthless now, when indemnitors offer it up prior to being asked for it, a quick database search indicates foreclosure proceedings have already begun. I have a form that authorizes me to charge their credit cards in the case of forfeiture, that they sign and all of their credit card information including the CVV code is on there. I will often take multiple credit cards on larger bonds for security. In this economic client, people are less likely to cancel cards and get new ones due to this piece of my contract because they may not get another one. I also have them fill out a full financial disclosure form and sign it. This is due to the increase of indemnitors filing bankruptcy on unpaid bail premiums as well as bond forfeitures. Legal precedence has established that these debts can and will be discharged regardless of the arguments of Jail break, etc. Fraud is not dischargeable in bankruptcy, but is difficult to prove. Case law has indicated successful exclusion of specific debts from bankruptcy by automotive lenders who were able to document that the financial statement offered when the loan originated differed greatly from the one offered when the subject filed for bankruptcy. This is why I have the financial disclosure form. If all of your other debts are discharged, you can focus intently on what you owe me!

I also have multiple indemnitors sign separate indemnity agreements, as I will not have one lie and the other swear to it. I don't bond the following charges: Sex Offenders, Pornography (child, internet etc.), Fugitive from Justice Warrants, Illegals Aliens (even with strong signors), defendants currently on bond with another agency (they probably still owe them money and that is why they did not return to them), Identity theft, and any subject I have bonded three times before (the 4th time, they run). I write very tight and prefer to chase my competition's skips. I hate chasing my own, theirs are much more fun and not so personal. I have never comprehended bondsmen telling me that since I have been recovering their skips, they write bonds now that they would never have touched before. A bad bond is still a bad bond. (I know that a good bondsman can make a bad bond a good one by bringing in more indemnitors of quality) I have also learned that when business is down, you have to write tighter, not looser. Never write a bond based on the bills you have currently due, it is the beginning of the end for you in this business.

I hunted fugitives for 8 years before I became a Surety Bondsman and then later, a Professional Property Bondsman. I do not believe in paying for the same real estate twice. I will learn from the mistakes of others, at their expense, not mine. This learning process has resulted in the rules I live by. I have witnessed bondsman come and go in this business, some protesting very loudly about their demise. In the 4 counties that are the mainstay of my business, there are 182 licensed Bondsman. Competition is fierce, bonds are scarce, honor and integrity left out of here years ago.
