Getting permission from a sheriff does not supersede a law. I have had LE tell me, while doing a call in (I had seen my subject getting into a car at a convenient store) "If they drive away, chase them, and don't let them out of your sight. Just be sure that you call and let us know so that we can get someone out to prepare the roads for a chase and assist in the stop." So, does that mean that I can get into a legal, high speed chase "because I was told...."? Absolutely not. I was also told, once, "If you find your subject with his girlfriend, cuff them both and call us. We have a misdemeanor traffic warrant for her. I can send someone to pick her up." Does this mean that I can legally apprehend or detain anyone with an outstanding warrant "because I was told...."? Again, NO. People use their interpretation of the law as fact anytime it suits them. I, for one, "feel" that a certified/licensed "Bounty Hunter" should be able to apprehend anywhere, at any time so long as they have proper paperwork (including a warrant and contract from the bondsman) due to the fact that "If they are good enough to get approved in their state, it should be good enough , nation wide." We all know, just because T vs. T says that we may cross state lines AND I feel the way I do, does not make it legal or right.
Go to a state with certain laws and run into the person that, either, doesn't know and wants to be sure to cover his hind end, or run into the one that DOES know ….. You will find yourself in a world of crap. You can call Sheriff Hill in Clayton County. He will tell you in a heart beat "If you are from out of state without a Georgia Certified escort, if you do not check in, if you infringe on any inalienable or civil rights, or if you cause too much of a public disturbance, you will be sitting in one of my cells." This is what he told me when I had my interview with him to get County Approval for Bail Surrender. He makes sure to get training on Bail Law for his officers, due to the large amount of bail recovery being done in Clayton County, so they know what is what. You can also call the Bonding department in Fulton.....ask for Teresa. You will be told the same sort of thing. It took me a month to get approved there and I had to have an interview (including a "what is legal" lecture) with one of the Officers in the department. I am sure, they will tell anyone the same thing that I was told.

Besides all of the stuff I have written above, if we are going to be professional about the whole thing, don't we want people doing the right thing? Don’t we want people to avoid being “cowboys and Rambo’s”? Don’t we want the guy, next to us, working to establish a good reputation for the industry, the same as we are doing? Perception and/or interpretation are nothing more than another way of saying "I want to do it my way so I will find the excuse that allows me to." If there is no solid example or case law, we need something in writing to state "I, Sheriff Lawdog, have approved and stated that....." and if traveling through 9 counties, 9 would be needed. Being told something on the phone will not stand up in court. Getting lucky to avoid jail time, after the fact, is just that….getting lucky. It helps no one, in the long run. To strengthen the reputation of this industry, we need to stop doing what we feel is right and start doing what is exactly right. Every time someone from this industry gets busted for something, it’s another black eye for us all. If you really want to do what is proper, correct, and best for our industry you can stand against those that knowingly break laws, no matter what their status, title, occupation, or relation and help to establish a reputable name for this community of workers. That would be in a perfect world, though……And this ain’t no perfect world.

Unless its changed since the last time we argued about this, show me the law that says out of state bondsmen cant pick up their own skips in Georgia. Unless something has changed, it doesnt exist. You say its implied, but I dont see it? Im not calling anyone. Ill do like I have done in the past and check in at the sheriffs office.
As for the professionalism, nothing has been done thats not professional. As stated in another thread, you become more creative when its YOUR cash on the line. Not just doing a pickup for someone else on their dime.....

LOL bubba, we have a new warrants officer here in Calhoun Co. If we get a solid address on someone out of state that has a FELONY warrant, she faxes the warrants to LE with jurisdiction of that address. Then she sends a sheriffs deputy to go pick them up from their jail then charges extradition fees to the inmate. They've recently made it SOP on all FTA felony warrants to be "NCIC NATIONWIDE". Very big help for us. We have been pretty lucky in GA. Out of the last 7 that skipped to GA, our warrants officer has helped with 6. The 1, well, I'll keep that one to myself...

Bubba and Andy are so very right about Texas. We beat this one up with Steve H. way back in the day LOL As for Georgia, I defer to Sno. He is the resident there. I defer to Andy L and Recoveryguy for Missouri. Laws are being amended all the time and what might be good today may not be tomorrow. The 'good ole boy' fellas seem to be quickly being replaced with those that want to 'follow the book' I was told yesterday that there will be some Bail Law changes here soon. Can't remember what she said it was all about. Will get the Update when it comes in.
