Got a call from a gentleman in Baltimore today. According to him, he paid a NC Bail Agent 1000.00 (face value of the bond) plus a 50.00 processing fee to bond someone out of a Charlotte NC jail. The case has been disposed of for over a month and the guy hasn't recieved his 850.00 dollar collateral from the NC Bonding Company even after many requests.

In NC, a Bondsman has 72 hours after disposal of a case to get the collateral in the mail or in person to the depositor. Also, in NC we can't legally charge misc. fee's including a so called processing fee.
This company is entitled to keep 150.00 for posting 1000.00 Bail and not a cent more.

I've given the man the information needed to ensure he get's his money back and to ensure that this bonding company feels the heat that is surely coming from NC DOI Investigators.

We must continue to weed these characters out!

If you get a chance give that person a call and find out the name of that Bail company in Charlotte. I am very interested in knowing which one it is. If you find out give me a call later.

Can you charge anything over the 10 percent?

North Carolina is 15% if I am not mistaken.
Virginia is 10% and we can add fees if in the contract and they are acceptable... I add a small fee for any bond under 5k... usually $25... some companies charge more, some none. I also have minimum that I charge... $150 ... so if the bond is under $1500... I still charge the $150... I will not leave my office for less than $150... if other bondsmen want to do it for a straight 10%... let them have it... I am not in business to lose money. It is also against current DCJS law to cut a bond fee for less than the 10% set . New law since July 2011.

There is now a sign posted in most of the clerks offices throughout my AO that reads: "Due to increased cost, there will be a 4% charge if a credit card is used to pay fines"... that used be illegal but if the courts can do it... so can I.... I also charge a fee but I tell the client about it up front, so there is no hidden fee involved. I, and probably no other bondsman can "eat" these fees... everyone charges, so I need to also... "cost of doing business".

Agent433,

In NC we can only charge 15 percent of the Bond amt. No fee's of any kind are allowed.

Some charge less, depending on the bond amount but anything more than 15% is not allowed.
